Academics urge government to do its utmost in Tak Bai case

Academics' believe that justice must be served to create peace in the southern border provinces. They pointed out that compensation money alone is not enough for the Tak Bai case. They urged the government to do its best to bring the suspects back for prosecution. They revealed that Thai law has problems. Even if the court accepts the case, the case can expire after the statute of limitations. They suggested a long-term solution. Mr. Prinya Thaewanarumitkul, a lecturer at the Faculty of Law, Thammasat University, talked about the case of the Tak Bai case, which is about to expire, whether it will affect the situation in the southern border provinces or not. He said that justice and peace go hand in hand. If you want peace in the three southern border provinces, don't use violence. Use the justice process. And if the Tak Bai case on October 25th does not have a single defendant come to court, there will be a very big question about justice and trust. When people lose trust, they may use other means. We have t o wait and see what the remaining government will do. Mr. Prinya said that the government is not in neutral. The Prime Minister also gave an interview that he was expediting various processes. However, the Royal Thai Police have a duty to arrest suspects and defendants according to arrest warrants in the cases in Narathiwat and Pattani provinces. The incident involved 4-5 layers of people, totaling 1,300 people, and 25 vehicles, traveling a distance of over 150 kilometers and taking 4-5 hours. At that time, it was the month of Ramadan when they were starving, causing them to suffocate. Compensation money alone would not create justice. The Narathiwat Provincial Court accepted the case and ruled that the actions were intentional and foreseen, even though they did not intend to kill at first. However, transporting people in this manner, as soon as the vehicle arrived, they knew that someone had died, but they did not order them to stop. 'Whether they are caught or not is one thing, but you have to see that th e government has done its best. After October 25, people will not criticize,' Assoc. Prof. Dr. Prinya Assoc. Prof. Dr. Prinya also said that after the statute of limitations, in terms of the law regarding the statute of limitations, we have a problem. Even though the court has accepted the case in Narathiwat Province, the case can still expire even though it has been accepted because the condition for the statute of limitations to not expire is to file a lawsuit with the court and bring the defendant to court. Normally, in other countries, if the court accepts the case, the statute of limitations must be interrupted or stopped, not counting the time or counting the time again. But in Thailand, the statute of limitations continues to count, so Thailand escapes until the statute of limitations expires. Therefore, in the long term, there are many cases like this involving corruption. It must be solved in the long term. Prinya added that if the defendant does not appear in court on October 25, we must wait to h ear the court on October 28. The court will issue an order, and after that, the government will have to come up with the results that have been released on what to do next, so we have to ask the government. Prinya also mentioned the case where Mr. Phumtham Vejjayachai, Deputy Prime Minister and Minister of Defense, gave an interview saying that the Tak Bai case should not be linked to politics, saying that General Pisal had already resigned from the Pheu Thai Party. The issue that is being discussed now is the government and the Prime Minister, who is the Commander of the Royal Thai Police. If you do what you see as doing your best, even if you cannot arrest anyone and bring them to court, even if the statute of limitations has expired, people will not blame the government. But if on the contrary, people feel that they have not done their best or think that there is no help, the government will be in trouble. And if the statute of limitations has expired, what will the government do next? Source: Thai News Agency
