Bangkok: The Department of Intellectual Property has issued a warning to AI-powered content creators, emphasizing the necessity of obtaining permission before using AI to cover or remix songs, due to the risk of copyright infringement.
According to Thai News Agency, the Department of Intellectual Property, under the Ministry of Commerce, released a statement to clarify the application of copyright law concerning the use of artificial intelligence, specifically Generative AI, in music creation and distribution online. The statement serves to inform creators and businesses that using copyrighted music for AI Voice Conversion, AI Remix, or modifying melodies and lyrics without proper authorization may lead to immediate copyright infringement, unless it falls under legal exceptions.
Ms. Oramon Sapthaveetham, Director-General of the Department of Intellectual Property, highlighted that while the Copyright Act of 1994 does not explicitly mention AI, any AI processes involving the copying or processing of copyrighted music files are seen as reproduction and modification of essential elements. Therefore, it is crucial for users to verify the copyright status and seek permission from all relevant parties, including lyricists, composers, record labels, and performers, unless the work is in the public domain or used for educational purposes without profit.
Additionally, the Department of Intellectual Property offers support to creators involved in legal disputes related to AI content modification on online platforms. This includes a mediation service for resolving intellectual property disputes collaboratively without resorting to court actions.
