Bangkok: The Cabinet acknowledged the Parliament's referral of the emergency decree on borrowing to the Constitutional Court for a ruling and instructed relevant agencies to prepare explanatory statements. The Cabinet recognized the Parliament's decision to seek a Constitutional Court ruling on the Emergency Decree concerning borrowing funds to address the energy crisis. This decree, crucial for the national energy transition planned for 2026, has been forwarded by the Speaker of the House of Representatives following the opinions of 133 Members of Parliament.
According to Thai News Agency, Ms. Ratchada Thanadirek, spokesperson for the Prime Minister's Office, stated that these Members of Parliament exercised their authority under Section 173, paragraph one, of the Constitution. They requested that the decree, which authorizes the Ministry of Finance to borrow funds, be reviewed by the Constitutional Court to determine compliance with Section 172, paragraph one, of the Constitution.
Furthermore, the Ministry of Finance, along with the Budget Bureau, the National Economic and Social Development Council, and other relevant agencies, has been directed to collaborate with the Office of the Council of State. They are to urgently prepare necessary clarifications and supporting documents. These documents will be submitted to the Cabinet Secretariat for further presentation to the Constitutional Court, ensuring a thorough review process.
