Cabinet Urges Quick Response as Emergency Borrowing Decree Referred to Constitutional Court

Bangkok: The Cabinet acknowledged the Parliament's referral of the Emergency Decree on borrowing money to address the energy crisis to the Constitutional Court for a ruling. Relevant agencies were instructed to prepare urgent explanations and documents before submitting them to the Cabinet Secretariat for further action.

According to Thai News Agency, Ms. Rachada Thanadirek, Spokesperson for the Prime Minister's Office, revealed that the Cabinet meeting acknowledged the opinion of 133 Members of Parliament. These members, exercising their authority under Section 173, paragraph one of the Constitution, submitted a petition to the Speaker of the House of Representatives. The petition requested that the opinion be forwarded to the Constitutional Court for a ruling on the matter.

The Royal Decree authorizing the Ministry of Finance to borrow money to address the impact of the energy crisis and initiate a national energy transition in 2026 is reportedly not in accordance with Section 172, paragraph one, of the Constitution. Consequently, this matter has been referred to the Constitutional Court for a ruling.

Furthermore, the Ministry of Finance, the Budget Bureau, the National Economic and Social Development Council, and other relevant agencies, in conjunction with the Office of the Council of State, have been instructed to urgently prepare clarifications and supporting documents. These documents are to be submitted to the Cabinet Secretariat for preparation to be presented to the Constitutional Court.
